Rochelle Phyllis Arends: Bail for Albany woman accused of stabbing strangers with scissors, denies charges

An Albany woman has denied she stabbed a man with a pair of scissors, causing his lung to collapse in Spencer Park last year and despite police objection, has been granted bail. Rochelle Phyllis Arends appeared via video link from Bandyup Prison in Albany Magistrates Court on September 18. She pleaded not guilty to the single charge of grievous bodily harm, alleged to have occurred on September 9, 2024. The 27-year-old is alleged to have been in the company of another person when they both jumped the side gate of a home in Spencer Park, according to police prosecutor Sgt Dylan Fisher. Ms Arends — who the court was told did not know the victim or anyone else at the home — then allegedly approached the man as he was drinking outside with his family and attacked him with a pair of scissors. She stabbed him deeply in the left side of his chest, before trying to stab at him again but only managing to scratch him. St John WA was called to the scene and took the victim to Albany Health Campus, where he was treated for a collapsed lung and other life-threatening injuries. In her bail application, defence counsel Georgia Hereford argued that the case would likely prove “extremely problematic” for the prosecution, alleging there was a lack of evidence to identify Ms Arends as the perpetrator of the stabbing. She said the victim and witnesses were all intoxicated at the time of the incident and had not been able to identify Ms Arends with certainty. She said slippers left behind at the scene by the perpetrator had not been linked to Ms Arends, and partial admissions the accused had made in an initial police interview were likely inadmissible as evidence due to a subsequent mental health episode that occurred later in the interview. Sgt Fisher opposed bail, citing the “extremely serious offending” and Ms Arends’ history with edged weapons, which includes at at least three instances of wielding a bread knife, meat cleaver and an axe in public places. He also referenced Ms Arends tendency towards violence, that most recently included two incidents of assaulting female prison officers by forcibly twisting their breasts as they served her food or medicine. He confirmed Ms Arends’ mental health had deteriorated later in her initial interview, but the partial admissions she made at its beginning did support the case “quite substantially”. Magistrate Erin O’Donnell said that, despite her “not encouraging record” she would grant Ms Arends bail to live at a Mira Mar address in light of the lingering doubts surrounding the prosecution’s case, and the fact it would likely take some time to work through the details. Ms Arends is subject to a personal undertaking of $2000 and has a curfew of between 8pm and 7am. Other conditions include compliance with her mental health treatment plan, urinalysis testing and a protective condition not to contact or go near the victim. She will next appear in Albany District Court on December 3 for a trial listing hearing.
