Great Southern mother jailed after injecting disabled daughter with insulin

A Great Southern mother who injected her severely disabled young daughter with insulin has been jailed, with the judge rejecting the State’s argument she was indifferent to whether or not she killed the girl. The woman, who cannot be named to protect the identity of her daughter, was in May found not guilty after a Supreme Court of WA trial of attempting to murder her daughter, but found guilty of endangering the child’s life. The girl was born in 2015 with the likelihood of not living into adulthood. Her mother became her full-time carer, but “reached the end of her ability” to do so, Prosecutor Ben Stanwix alleged at trial, and “decided to euthanise her”. The court was told she turned to family doctor Pieter Austin in the midst of the COVID pandemic and he prescribed insulin, but she threw it away. When she returned to his surgery the following month, the doctor again prescribed insulin, which she then injected into the girl while her husband and three older children were at the beach. The injection caused the girl’s insulin levels to soar more than 40 times what would be expected, discovered hours later after the child had been taken to hospital, driven by her parents. The woman initially denied any knowledge but admitted she had done it when interviewed by police, responding when asked what she thought might happen that the child would either “go peacefully” or end up in hospital. At the woman’s three-hour sentencing hearing on Friday, Mr Stanwix argued that the woman was “really not caring which of the two outcomes happened”. “She had lost hope for the future,” the prosecutor said. But Justice Marcus Solomon said he did not accept the woman planned to cause death, rather that she intended and expected her child’s health would be sufficiently compromised to require hospitalisation. Defence barrister Anthony Eyers argued that his client went to “tremendous lengths” to care for her child and acted in desperation, wanting the girl to be admitted as a hospital inpatient, conceding it was “a crazy way to get help”. Justice Solomon said the woman wrote in a letter to the court that her child was declining during the pandemic and not getting the medical assistance she needed. It was a unique and moving case that inspired sympathy for the woman, who had faced tragic circumstances, he said. He said the woman had an untreated, underlying depressive illness and accepted she “provided years of dedicated love and care”. Thankfully, the child did not suffer a permanent impairment. But the case was very serious, Justice Solomon said, noting the child would have died without medical intervention. He handed the woman a three-year jail term, taking into account 104 days she had spent in custody. She must serve half of that, so her soonest release on parole is October next year. The court was told the woman had been subjected to overly restrictive home detention that preventing her from living with her family since being arrested about 10 days after injecting her daughter. Austin, who was a key witness in the trial, pleaded guilty to attempted murder and was sentenced to five years and six months behind bars, which was upheld on appeal. Reflecting on parity, Justice Solomon said the circumstances of Austin’s case were different. He was convicted of a more serious charge, “had all the duties of a doctor” and was not overwhelmed by the circumstances surrounding the child’s condition as the mother was, the judge said. Austin testified that in late 2021, the woman was “at the end of her tether” and had revealed to him that she had tried to kill her daughter. “She tried to smother her with a pillow,” he said on the stand. “She said she put glad wrap over a pillow and smothered her but that she wouldn’t die.”
