Bunbury man Craig Fagan fined $800 for exposing himself in front of adult store employee

A 44-year-old Bunbury man has been fined $800 for exposing himself in front of a female adult store employee. Craig Stewart Fagan appeared in the Bunbury Magistrate’s Court on Thursday where he pleaded guilty to committing an indecent act in public. The court was told Fagan visited The Adult Shop during the afternoon of July 1 and walked towards the DVD section after he was greeted by the employee. Several minutes later, Fagan returned to the front counter, where the employee asked if he was after any help, when he pulled down his pants and exposed himself to the employee. When the employee told Fagan to leave, he pulled his pants back up and left the store, as the employee took a photo of Fagan’s parked car and called the police. Although Fagan made full admissions to the offending when interviewed by police, he was unable to give an explanation for the offending. The court was also told the victim felt uneasy after the incident and told police she was considering handing a banning notice to Fagan, barring him from the store. In sentencing, Magistrate Joanne Andretich acknowledged that Fagan must have been embarrassed by the offending and that the victim must have been “frightened” after being confronted in such a way. Despite receiving the fine and being ordered to pay court costs, Fagan was spared having the conviction recorded as he had no prior criminal record.
