Bunbury teenager spared detention over kissing 14-year-old and filming naked encounter in hotel room bathroom

A 17-year-old girl has avoided a jail term after she was caught filming herself and a 14-year-old girl kissing naked in a Bunbury hotel bathroom while an older man was allegedly present. The court was told the two girls were drinking together in a hotel room at The Prince of Wales Hotel in Bunbury on November 16, 2021, allegedly accompanied by a 23-year-old man, when the 17-year-old then took the victim to the hotel bathroom and used her mobile phone to film them kissing naked. The man, who was also arrested and charged but released on bail, is now believed to be on the run after failing to appear in court. Magistrate Benjamin Tyers said the case against the 17-year-old was “an unusual one”. “But because of (the teenager’s) co-operation with police, referring her to the juvenile justice team was a just outcome,” he said. While the teenager was initially due to face trial over her involvement, she was sent to juvenile justice instead of detention — despite the serious charges of indecently dealing with a child aged between 13 and 16, and producing child exploitation material. In submissions, the girl’s defence counsel Derek Hunter told the court she accepted responsibility for the offending, however she did not know the victim was 14 years old at the time, believing her to be 17 years old.
