Mandatory mental health assessment introduced for WA gun owners to legally obtain and keep a firearm licence

WA gun owners will have to pass a mandatory mental health assessment to legally obtain and keep a firearm licence in a major Australian-first initiative aimed at saving lives. Police Minister Paul Papalia will on Sunday announce the significant policy as part of the McGowan Government’s overhaul of the State’s “outdated” and decades-old gun laws. WA will be the first State in Australia to force gun owners to undergo testing to prove they are mentally fit to hold a firearm. It comes as statistics exclusively obtained by The Sunday Times reveal that a staggering 20 people were shot dead in WA last year alone. Police believe mental health issues played a role in almost 50 per cent of those deaths. “If 20 people were all gunned down in a public place, we would rightfully call it a massacre,” Mr Papalia said. And in the past six months, WA Police have had 122 people referred to the agency because of concerns about their fitness to hold a gun licence based on medical grounds. Police were able to revoke 46 firearm licences on mental health grounds during that period. As well as playing a part in a spate of firearm deaths last year, mental health was also said to be a factor in some of WA’s — and Australia’s — worst tragedies. The Osmington massacre in 2018 was the worst shooting in the country’s history since Port Arthur in 1996 when 35 people were killed. Cynda Miles was shot dead by her husband Peter, who also killed their daughter, Katrina Cockman, and her four children, Taye, 13, Rylan, 12, Arye, 10, and Kaydn, 8. He then shot himself. Breaking her silence to The Sunday Times two years ago as part of a firearms safety campaign, Cynda’s sister Helen Page revealed Peter was struggling with mental demons before the murders. “We knew Peter was suffering, especially since starting prescribed medication,” she said. “There were noticeable changes. He and Cynda had many hardships over the years and Peter would focus on the past and blame himself for things that he had no control over. “He didn’t smile as often and seemed to have lost his joy. He admitted he wasn’t coping and that he felt useless. He was suffering from anxiety attacks.” Several family friends said Mr Miles was under financial stress had had changed antidepressant medication in the days before the shooting. In 2018, Yuna farmer Rodney Vlahov took his own life on his family farm after shooting dead his long-term Geraldton accountant Phillip Chamberlain. Those close to Mr Vlahov spoke of how he had come under increasing pressure to run his farm and was struggling to cope. Mental health is also believed to be a contributing factor to the horrifying shooting of constables Rachel McCrow and Matthew Arnold in Queensland in December. The mental state of the shooters, particularly Nathaniel Train, had reportedly spiralled in the lead-up to the murders that sent the country into shock. It is understood firearm licence holders will be potentially subject to ongoing mental health checks but the details will be subject to consultation with farmers, doctors and mental health bodies. Mr Papalia said police had already conducted an “extensive” initial round of consultation which he said has “revealed strong support for this initiative among farmers, the medical community and victims of firearms violence”. “Police will continue to work closely with these important stakeholders to refine the regulations,” he said. Mr Papalia said many people in society lived with mental health challenges at some stage in their lives and most people who do are not violent and did not pose a threat to the community. However, Mr Papalia said “introducing compulsory mental health screening for firearm owners increased the chance of identifying someone who should not be granted access to a firearm for safety reasons”. “It also decreases the chance of that person doing harm to themselves or others,” he said. “If mental illness is identified during the application process, we want it to be an opportunity and a pathway for the individual to receive the support they need.” Mr Papalia added: “This is an Australian first. We believe this and other initiatives we are working on will help save lives, make our community safer, and make the job safer for our officers.” Other powers so far announced as part of the sweeping change to WA’s gun laws include the introduction of firearm prohibition orders, aimed at keeping dangerous weapons out of the hands of criminals such as bikies and domestic violence perpetrators. The first round of the orders were handed out to high-profile bikies including Mongols Troy Mercanti, Clovis Chikonga and Jason Gastarov as well as Rebels boss Karl Labrook and senior Coffin Cheater Benjamin Orton. That came after it was revealed that outdated laws meant 300 bikies or gang associates had legal access to guns. Joseph Versace was allegedly shot dead by Rebels associate Joshua Duperouzel in an example of alleged gang gun violence in Gnangara last year. WA’s mental health gun policy comes after a national firearms register became a step closer following national cabinet in Canberra on Friday. Anthony Albanese said the Premiers and Chief Ministers had agreed to a “nationally co-ordinated approach to the management of firearms”. The Prime Minister said national cabinet received a high level briefing by ASIO director-general Mike Burgess about the rise of right-wing extremism in Australia and of so-called “sovereign citizens”. The nation’s police ministers will report back to national cabinet mid-year, with options to implement a national register.
